1. Acceptance of Terms
By accessing or using the Fodhli platform (the "Service"), including our website and mobile applications, you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, you may not access or use our Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Fodhli is a marketplace platform that connects customers seeking home services with independent, verified service providers in Tunisia. Fodhli acts solely as an intermediary and does not itself perform any of the services listed on the platform. We facilitate the connection between service seekers and service providers, but we are not a party to the agreement between them.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. You must notify us immediately of any unauthorized use of your account.
4. Service Provider Terms
Service providers on the Fodhli platform are independent contractors, not employees of Fodhli. Providers are responsible for the quality of their work, their own insurance, and compliance with all applicable local laws, licenses, and regulations. Fodhli does not guarantee the availability, quality, or outcome of any service performed by providers.
5. Payments & Fees
Payments for services are arranged directly between customers and service providers. During our launch period, Fodhli does not charge commission fees to providers. We reserve the right to introduce fees in the future with advance notice. All prices displayed on the platform are estimates and may vary based on the actual scope of work.
6. User Conduct
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. You shall not attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems connected to the Service. Harassment, abuse, or harmful behavior toward other users or providers is strictly prohibited.
7. Reviews & Ratings
Users may leave reviews and ratings for service providers after completed jobs. Reviews must be honest, accurate, and based on genuine experiences. Fodhli reserves the right to remove reviews that violate our community guidelines, including fake reviews, spam, or content containing personal attacks or discriminatory language.
8. Limitation of Liability
Fodhli shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses. Our total liability shall not exceed the amount you paid to Fodhli in the past twelve months.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
10. Modifications
Fodhli reserves the right to modify these Terms at any time. We will notify users of significant changes by posting an update on our website and, where possible, by email. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
11. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service will cease immediately.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Tunisia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tunis.
